Terms & Conditions

Version 1.0

This document is a draft prepared for BarBook.be and must be reviewed by a Belgian legal professional before it is relied upon. It is not legal advice.

1. About BarBook.be

BarBook.be is an online platform operated by [COMPANY NAME] (company number [COMPANY NUMBER], [COMPANY ADDRESS]). It connects customers with independent professional bartenders for weddings, private parties, corporate events, festivals, birthdays, cocktail events, flair bartending and other events.

BarBook.be is a marketplace. Unless a service is expressly offered by BarBook.be itself, BarBook.be is not the bartender's employer, not the event organiser and not the provider of the bartending services. The bartending service is provided by the bartender.

2. Bartender registration

Creating a bartender profile is free. Bartenders must provide accurate, complete and up-to-date information. Bartenders may only use their own:

  • Name
  • Photos
  • Experience
  • Specialties
  • Certifications
  • Work examples

False or misleading information is prohibited.

3. Customer accounts

Customers must provide accurate information and use the platform responsibly. You are responsible for keeping your login details confidential.

4. Profiles

Bartenders can display a profile photo, experience, specialties, services, photos, reviews, location or working area, availability and, where applicable, pricing. Bartenders are responsible for all content they publish.

5. Booking requests and confirmed bookings

A booking request is a request sent by a customer to one or more bartenders. It is not yet a binding booking.

A booking becomes confirmed only after the required confirmation process is completed: every bartender in the request has accepted it (including the BarBook.be commission) and the required deposit has been paid.

Both parties have access to the date, time, location, services, price, additional costs and other agreed conditions of the booking.

The service agreement for the bartending service is directly between the customer and each independent bartender who accepts the booking. BarBook.be acts only as a booking and intermediary platform and does not personally provide the bartending service.

6. BarBook.be platform commission

BarBook.be charges and collects a 10% platform commission on bookings made through the platform. The commission is deducted from the booking amount before the bartender's payout.

  • The commission is collected by BarBook.be, not by the bartender.
  • The bartender does not charge the customer the BarBook.be commission.
  • The customer is not charged an additional commission on top of the booking price, unless clearly shown otherwise before booking.
  • There is no commission for simply having a profile. The commission applies only to bookings successfully made through BarBook.be.

Example: booking value €500 — BarBook.be commission €50 — bartender payout €450.

7. Commission avoidance

Bartenders and customers who were connected through BarBook.be must not intentionally move a booking outside the platform to avoid the BarBook.be commission. This includes sharing contact details to arrange the same event off-platform. BarBook.be may take the measures described in section 14 when commission avoidance is detected.

8. Payments

Payments are processed by a third-party payment processor. The payment processor handles payment processing; BarBook.be is the platform that charges the platform commission; the bartender receives the booking amount minus the commission as a payout.

9. Cancellations

Customer cancellation: a customer may request cancellation through BarBook.be. Whether a refund or a cancellation fee applies depends on the cancellation conditions shown at the time of booking.

Bartender cancellation: a bartender who can no longer perform a confirmed booking must notify the customer and BarBook.be as soon as possible. Repeated cancellations may result in warnings, restrictions or suspension.

10. Bartender responsibilities

Bartenders are responsible for:

  • Arriving on time
  • Providing the agreed services
  • Professional behaviour
  • Communication with customers
  • Having the necessary skills and equipment
  • Following applicable Belgian laws and alcohol regulations
  • Any required permits, licences or insurance
  • Providing accurate profile information

11. Bartender no-show

The bartender is solely responsible for properly and timely performing any booking they have accepted.

If a bartender fails to appear at the agreed date, time and location without a valid reason, BarBook.be is not responsible for the failure to provide the bartending service, including any resulting damages, additional costs, losses or other consequences. The service agreement is between the customer and the bartender. BarBook.be acts as a booking and intermediary platform and does not personally provide the bartending service.

If a bartender does not show up, BarBook.be may, where reasonably possible, assist the customer. BarBook.be may also take appropriate action against the bartender, including:

  • Issuing a warning
  • Temporarily restricting the bartender's account
  • Suspending the bartender's profile
  • Permanently removing the bartender's profile in cases of serious or repeated violations

12. Customer responsibilities

Customers are responsible for:

  • Providing accurate event information
  • Providing a safe working environment
  • Providing the correct date, time and location
  • Respecting bartenders
  • Paying according to the agreed booking conditions
  • Communicating changes as soon as possible

13. Alcohol and legal compliance

Bartenders and customers must comply with applicable Belgian laws and regulations concerning alcohol and events. Bartenders must not serve alcohol where doing so would violate applicable law, including to minors. BarBook.be is not responsible for illegal behaviour by individual customers or bartenders.

14. Reviews

Customers may leave reviews after completed bookings. Reviews must be honest, based on an actual experience, relevant and respectful. Fake reviews, review manipulation, threatening someone over a review, paying for fake reviews and artificially increasing ratings are prohibited. BarBook.be may moderate or remove reviews that violate these rules.

15. Prohibited behaviour and account measures

Prohibited: fraud, spam, harassment, threats, discrimination, illegal activities, fake profiles, false information, payment fraud, abuse of personal information, platform manipulation, commission avoidance and attempts to compromise website security.

When users violate these Terms or applicable law, including when a bartender fails to perform an accepted booking, BarBook.be may send warnings, temporarily restrict accounts, suspend profiles, remove profiles or content, or permanently ban users.

16. Intellectual property

BarBook.be branding, logo, design and software are protected where applicable. Users may only upload content they have the right to use. Bartenders are responsible for the photos and videos they upload. BarBook.be content may not be copied or reproduced without permission.

17. Liability

BarBook.be acts as a booking and intermediary platform and does not personally provide the bartending service. The bartender is solely responsible for performing the service agreement with the customer.

Nothing in these Terms limits or excludes any liability that cannot legally be excluded or limited under applicable mandatory law.

Nothing in these Terms affects your mandatory rights under Belgian and EU consumer law.

18. Changes to these Terms

When a new version of these Terms is published, users will be asked to accept it.
